This act legislates the State of Utah's protest against the Real ID Act. It boldly states that the United States' Congress enactment of the Real ID Act is:
Harmful to the security of Utahns, Will cause unneeded expense and inconvenience, and Is in violation of the Tenth Amendment of the U.S. Constitution
The act prohibits implementation in the state of Utah and requires the division to report any attempts at implementation to the governor.
While it is important for Utahns to continue fighting this dangerous act, it should be noted that recent changes in drivers' licensing laws have already gone into effect which bring Utah ID's into compliance with the Real ID Act. However, passing this law may still enable state officials to fight the enforcement by federal agents in requiring the use of federally approved ID's. This act should have been passed last year, but in this important issue, late is better than never.
